VRGD STUDIOS END USER LICENSE AGREEMENT
License version 1.0 - effective October 17, 2026
For: FlatOut 4 VR + Motion (an unofficial mod for FlatOut 4: Total Insanity VR)

THE GAME IS NOT INCLUDED
This is a mod. It does not include the game. You need your own copy of FlatOut 4: Total Insanity VR,
bought and installed through Steam. The game, its files, names and artwork are the property of their
owners and are not part of this package or of this license.

THE SHORT VERSION (a summary only - the full terms below are what count)
 - Free for your own personal use, with or without a motion rig. Streams and videos, including
   monetized ones, are welcome.
 - Don't sell it, re-upload it, change its program files, decompile it, or feed it to an AI.
 - Arcades, venues, events, rentals and other businesses need a paid commercial license.
 - Motion rigs can hurt you. Keep the emergency stop in reach. You ride at your own risk.
 - Unofficial mod: not made or endorsed by the game's developers or publisher, or by YawVR.

PLEASE READ THIS BEFORE INSTALLING
This is a legal agreement between you and VRGD (see Section 1). To install the VRGD Software you
must tick two boxes in the installer: one to agree to this license, and one to confirm that you
accept the motion risks in Section 5 and the release in Section 7(b). By ticking them you confirm
that:
 - you have read this license and agree to it;
 - you are at least 18 (or the age of adulthood where you live), or your parent or legal guardian
   has read this license and is agreeing to it for you; and
 - if you are accepting for a company or other organisation, you are allowed to bind it, and "you"
   includes it.
If you copy, install or use the VRGD Software in any other way, you also accept this license. If
you do not agree, do not install, copy or use the VRGD Software, and delete any copy you have:
without this license you have no right to use it at all. You can save or print this license at
any time. A copy is installed with the program as VRGD-EULA.txt.

1. WHO AND WHAT THIS COVERS
This license is between you and VRGD Studios LLC, of Missouri, USA ("VRGD", "we", "us").

It covers only what VRGD made (the "VRGD Software"):
 - the launcher and installer, FlatOut 4 VR Motion.exe;
 - the GameLink motion plugin, FlatOut4Plugin.dll;
 - the motion link, VRGD-Telemetry-Bridge.exe, and its settings file flatout4-tuning.cfg;
 - this game's OpenXR-MotionCompensation settings file, the manual, and this license; and
 - any update, fix or new version of these that VRGD provides.

The game is NOT VRGD Software. This package does not change any of its files; it starts the game
through Steam, the way Steam's own Play button does, and reads the motion data the game itself sends.

This license is not the license for anything else, including: the game FlatOut 4: Total Insanity VR;
YawVR GameLink; SimHub; Sim Racing Studio; OpenXR-MotionCompensation; Steam; Microsoft .NET; and your
headset's software. Those are governed by their owners' own terms. See
THIRD-PARTY-NOTICES.txt.

Open-source parts. Open-source software keeps its own license. Nothing in this license limits any
right an open-source license gives you, including your rights under the licenses of the open-source
parts listed in THIRD-PARTY-NOTICES.txt. Section 3 applies only to the VRGD Software.

2. WHAT YOU MAY DO
If you accept this license and keep to it, VRGD grants you a free, personal, non-exclusive,
non-transferable, revocable (see Section 10), worldwide license to install and use the VRGD
Software, as downloaded from VRGD's official download page (https://vrgamerdude.com/flatout-4-vr-motion/), on computers
you own or control, with or without a motion rig, for non-commercial use, with a copy of the game
that you own. You may also:
 - let family and friends ride your setup for free while you supervise them (see Section 5);
 - stream, record and post videos of gameplay that uses it, including monetized ones (ads,
   subscriptions, memberships, tips, donations and sponsorships). Please credit "VR + motion mod by
   VRGD Studios" and link the official download page;
 - open, read and change the plain-text settings, tuning and profile files for your own use (that
   is what they are for), and tell other people the setting values you use. Do not share the files
   themselves; point people to the official download page instead; and
 - keep backup copies for your own use (the installer's own backups count).
This license is conditional and limited: it covers only the uses described in this section, and
only while you keep to Section 3. Any other use - including Commercial Use without a commercial
license, redistribution, or any use after this license ends - is not licensed and infringes VRGD's
copyright.

3. WHAT YOU MAY NOT DO
Unless VRGD gives you written permission, you may not, and you may not help, allow or pay anyone
else to:
 a) sell, rent, lease, lend, sublicense or charge for the VRGD Software or access to it;
 b) share, upload, re-host, mirror or bundle it anywhere, even free and unchanged - for example on
    file-sharing or mod sites, Discord, torrents, modpacks, repacks or disk images, or preinstalled
    on a PC, headset or rig. Linking to the official download page is always fine;
 c) use it for Commercial Use without a commercial license from VRGD. "Commercial Use" means using
    the VRGD Software: (1) anywhere people pay, directly or indirectly, to use it or ride with it
    (per ride, by time, entry fee, membership, party or event ticket, or as part of renting a rig
    or PC); (2) at a business or event open to the public, such as an arcade, location-based
    entertainment venue, VR center, store, bar, cafe, mall or show, even if riding is free; (3) to
    demo, advertise or sell hardware, software or services; or (4) installed on or bundled with a
    PC, headset or rig that is sold, rented or leased. Making streams and videos (Section 2) is not
    Commercial Use. Per-seat commercial licenses are available from VRGD (Section 13);
 d) reverse engineer, decompile, disassemble, decrypt or unpack the VRGD Software, or try to
    recover its source code; run it under a debugger, dump its memory, or hook, trace or intercept
    its code, data or messages; record what goes into and comes out of it (such as the motion
    commands it sends your rig) in order to work out or copy how it works; or remove, disable or
    get around any protection in it (such as obfuscation, encryption, integrity or tamper checks);
 e) give, upload, paste or otherwise feed any of the following to an artificial intelligence or
    machine-learning system (including chatbots, coding assistants, large language models, AI
    agents, and their training, fine-tuning, retrieval or "context" data): the VRGD Software or its
    program files; any code, memory dump or other material taken or decompiled from them;
    recordings of its outputs, such as the motion data it produces; or any description of how its
    code works. This applies whatever the reason. You also may not use such a system to do anything
    else this section forbids. One exception: you may ask an AI assistant for help getting your own
    copy working, using the manual, an error message, a log file or your own setting values;
 f) change the VRGD program files (the .exe and .dll files), share a changed version of any VRGD
    Software file, or remove or change any copyright, license or other notice in it;
 g) use anything you learned about how the VRGD Software works inside - by doing anything in (d)
    or (e), or in any other way that is not public - to make, or help anyone make, software that
    copies, is substantially similar to, or competes with the VRGD Software, or pass that knowledge
    on to anyone else;
 h) use it with a copy of the game that you did not obtain from the game's official stores, or to
    get around the game's own protection or its owners' terms. The installer looks for the game
    in Steam and does not install or start otherwise; or
 i) use it to break the law. (You are responsible for following the terms of the game, its store
    and any other service you use it with.)
Where the law where you live gives you a right that a contract cannot take away (for example, in
the EU and the UK, the right to make a backup copy, to observe, study and test how the program
runs, or to decompile it to make an independently created program work with it), this section
does not stop you - but you may do only exactly what that law allows, only for the purpose it
allows, and nothing more. Because that law allows decompiling only when the information needed is
not already readily available, you must first ask VRGD for it at don@vrgamerdude.com. Section 3(d)
does not apply to the plain-text files described in Section 2, or to the open-source parts in
Section 1.

4. OWNERSHIP AND CONFIDENTIALITY
The VRGD Software is licensed, not sold. VRGD keeps all rights in it, including copyright and trade
secrets; third-party parts belong to their owners. Any rights not expressly granted here are
reserved. The VRGD Software, including the motion code in its GameLink plugin and its motion link,
contains VRGD's confidential information and trade secrets. You agree not to disclose or
publish anything you learn about how it works inside that is not already public, except as Section
3 allows. You agree that breaking Section 3 or this section could cause VRGD harm that money alone
cannot fix. VRGD expressly reserves all its rights in the VRGD Software against text and data
mining, including under Article 4(3) of EU Directive 2019/790 and any similar law.

5. MOTION SIMULATOR SAFETY - READ THIS
Motion rigs move your body hard and fast. Riding one, especially in VR where you cannot see the
room, can cause motion sickness, dizziness, falls, seizures and serious injury - in rare cases even
death - and can damage your equipment or home. You ride entirely at your own risk, and you accept
these risks.
 - This software is not a safety system. It does not watch the rider and cannot stop your rig in
   an emergency. Software - including the VRGD Software - can have bugs. A bug, a crash, a game
   update, lost tracking, a bad setting or a lost connection can make the rig move suddenly,
   violently, the wrong way or in a way you do not expect, or leave it tilted.
 - The motion comes from the data the game itself sends while it runs. A game update can change
   that data; the motion code is built to hold the rig at rest when what it reads does not add up,
   but no check is perfect.
 - Keep your rig's emergency stop within reach every time you ride, and know how to use it. Use
   the rig's seat belt or harness if it has one.
 - Follow your rig's and headset's instructions and limits, including weight, height and age
   limits. Keep the rig's own speed and angle limits and safety stops in place. Set the rig up on a
   firm, level floor exactly as its maker says.
 - Keep the area around the rig clear: no people, pets, furniture or loose items within its reach
   while it moves. Route cables so they cannot snag, wrap around or catch you as the rig turns.
 - Get in and out only when the rig is parked and has stopped moving.
 - Do not ride if you are pregnant; have heart, blood-pressure, back, neck, joint, bone, inner-ear
   or balance problems; have epilepsy or have ever had a seizure or blackout; are recovering from
   surgery or injury; or have any condition a motion ride could affect. If unsure, ask a doctor
   first. Never ride after alcohol or drugs, or when very tired.
 - Stop at once if you feel sick, dizzy, disoriented or uncomfortable. Do not drive or do anything
   risky until you feel normal again. Take regular breaks.
 - Anyone under 18 (or the age of adulthood where they live) may use the VRGD Software only if a
   parent or legal guardian has accepted this license for them and a parent, guardian or other
   responsible adult watches the whole session with the emergency stop in reach - and never if
   they are below the rig maker's minimum age, height or weight. A parent or guardian who accepts
   this license for a minor accepts the risks in this section for that minor and is responsible for
   the minor's use.
 - The installer never changes the settings of your motion program (YawVR GameLink, SimHub or Sim
   Racing Studio). How strongly your rig moves is set there, and in the tuning files of this
   package. Changing the tuning, profile or your motion program's settings, or using a rig, seat or
   setup different from ours, can make the rig move farther, faster or harder. Change things in
   small steps and test gently. Anything you change is your responsibility.
 - If you let anyone else ride, you are responsible for their safety, for giving them these
   warnings, and for supervising them.

6. NO WARRANTY
TO THE FULLEST EXTENT ALLOWED BY THE LAW THAT APPLIES TO YOU (SEE SECTION 8), THE VRGD SOFTWARE IS
PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED,
INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR
THAT IT IS FREE OF ERRORS OR WILL WORK WITH YOUR HARDWARE, YOUR GAME VERSION, OR FUTURE UPDATES OF
THE GAME OR OTHER SOFTWARE.

7. LIMITATION OF LIABILITY
(a) TO THE FULLEST EXTENT ALLOWED BY THE LAW THAT APPLIES TO YOU (SEE SECTION 8), VRGD WILL NOT BE
LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA
OR DAMAGE TO YOUR COMPUTER, MOTION RIG OR OTHER PROPERTY, ARISING FROM OR RELATED TO THE VRGD
SOFTWARE OR ITS USE WITH ANY MOTION RIG, EVEN IF VRGD WAS TOLD SUCH DAMAGE WAS POSSIBLE.

(b) RELEASE OF INJURY CLAIMS - READ CAREFULLY. WHERE THE LAW ALLOWS IT, YOU ACCEPT THE RISKS
DESCRIBED IN SECTION 5, AND, FOR YOURSELF AND ANYONE CLAIMING THROUGH YOU (SUCH AS YOUR HEIRS) AND,
IF YOU ACCEPT FOR A MINOR, FOR THAT MINOR, YOU RELEASE VRGD FROM, AND AGREE NOT TO SUE VRGD FOR,
ANY PERSONAL INJURY OR DEATH ARISING FROM USING THE VRGD SOFTWARE WITH A MOTION RIG, INCLUDING
INJURY OR DEATH CAUSED BY VRGD'S OWN NEGLIGENCE OR FAULT. THIS RELEASE DOES NOT COVER GROSS
NEGLIGENCE, RECKLESSNESS OR INTENTIONAL MISCONDUCT, AND IT DOES NOT APPLY WHERE SECTION 8 SAYS IT
DOES NOT.

(c) EXCEPT FOR CLAIMS FOR DEATH OR PERSONAL INJURY (WHICH SECTIONS 7(b) AND 8 DEAL WITH), VRGD'S
TOTAL LIABILITY TO YOU FOR ALL CLAIMS TOGETHER IS LIMITED TO US$10.

(d) WHERE THE LAW ALLOWS IT, YOU WILL COVER VRGD'S REASONABLE COSTS, INCLUDING LEGAL FEES, OF ANY
CLAIM MADE AGAINST VRGD BY SOMEONE ELSE THAT IS CAUSED BY YOUR BREAKING THIS LICENSE, OR BY YOUR
FAILING TO SET UP OR SUPERVISE YOUR RIG, OR TO WARN A RIDER, AS SECTION 5 REQUIRES.

(e) NOTHING IN THIS SECTION 7 LIMITS ANY LIABILITY THAT SECTION 8 SAYS CANNOT BE LIMITED.

8. YOUR RIGHTS UNDER LOCAL LAW
Many countries, states and provinces give consumers rights that a contract cannot take away.
Nothing in this license takes those rights away. In particular:
 - Everywhere: VRGD does not exclude or limit its liability for fraud, for gross negligence or
   deliberate misconduct, or for anything else that the law where you live says cannot be excluded
   or limited.
 - If you live in the European Union, the United Kingdom, Australia, New Zealand, Quebec, or
   anywhere else whose law does not allow it: Section 7(b) and the US$10 limit in Section 7(c) do
   not apply to death or personal injury, and VRGD is responsible for death or personal injury
   caused by its negligence, and for any other loss, as far as your local law makes VRGD
   responsible and does not allow that to be excluded or limited.
 - Australia: nothing in this license excludes, restricts or changes any right or remedy you have
   under the Australian Consumer Law that cannot lawfully be excluded, restricted or changed.
In those places, Sections 6 and 7 apply only as far as your local law allows.

9. NOT AFFILIATED
VRGD Studios is independent. FlatOut 4 VR + Motion is an unofficial mod for FlatOut 4: Total
Insanity VR. It is not made, approved, endorsed or supported by the game's developers or publisher,
Valve, Microsoft, ShallXR, YawVR, SimHub, Sim Racing Studio or any headset maker. Please do not
contact them for help with this mod; contact us. FlatOut is a trademark of its owner. Other names are
trademarks of their owners and are used only to say what this mod works with. The game is not
included and remains the property of its owners.

10. UPDATES AND TERMINATION
VRGD may release new versions of the VRGD Software with a new version of this license. The
installer shows you the new license, and it applies only to a version you install after agreeing
to it; it does not change the terms you agreed to for an earlier version. This license ends
automatically if you break Section 3, and VRGD may end it by notice to you if you break any other
term. VRGD may also end it for everyone by giving reasonable notice on its official download page,
or straight away if the law requires VRGD to stop offering the VRGD Software. When this license
ends, you must stop using the VRGD Software and remove every copy: run "Uninstall" (in the
launcher, or from the "FlatOut 4 VR Motion - Uninstall" shortcut in the Start menu); when it
has finished, delete the zip and folder you downloaded. Sections 1, 3 to 9, 11, 12 and 13, and the
duty to remove copies in this section, continue after this license ends.

11. GOVERNING LAW AND COURTS
This license, and any dispute or claim arising out of or relating to it or to the VRGD Software
(whether based on contract, negligence or other tort, statute, or anything else), is governed by
the laws of the State of Missouri, USA, without regard to its conflict-of-law rules. The United
Nations Convention on Contracts for the International Sale of Goods does not apply. Any such
dispute will be decided only by the state courts in Greene County, Missouri, or the
United States District Court for the Western District of Missouri, and you
agree to their jurisdiction.
If you are a consumer and live outside the USA:
 - you keep the protection of the mandatory consumer laws of the country where you live; choosing
   Missouri law does not take that protection away; and
 - you may bring a claim against VRGD in the courts where you live, and where the law there
   requires it, VRGD will bring any claim against you only in those courts.
VRGD may ask any court, in any country, for an urgent order (such as an injunction) to stop anyone
copying, sharing, reverse engineering or otherwise misusing the VRGD Software.

12. GENERAL
If a court finds any part of this license unenforceable, that part will be enforced to the
greatest extent the law allows (or, where the law does not allow that, removed), and the rest stays
in force. Not enforcing a term is not a waiver of it. This license is the whole agreement between
you and VRGD about the VRGD Software, except for any separate written license signed by VRGD (such
as a commercial license), which takes priority for the use it covers. You may not transfer this
license. VRGD may transfer it to anyone who takes over the VRGD Software, without reducing your
rights under it. If this license is translated, the English version controls where the law allows.
